What is the name of your state (only U.S. law)? I have a 19yo son who began dating a 14yo girl. She told him that she was 17yo. To make a long story short, they had sex and after her 15th birthday (we thought 18) we find out that she's pregnant. After she gets pregnant she informs him that she's only 15 and that if he don't marry her she will have him arrested for statutory rape. Does anyone know of cases such as this where the female has lied? Does this help in the boy's defense? Does anyone know the average sentence for statutory rape in Maryland?

a little more info

We have since found out that her mother had her at about 16, the grandmother had the mother at 15. The mother has been in jail several times. What chance would we have trying to get custody of the baby? Would any of this info help in the statutory rape case? We believe that the girl deliberatly planned on getting pregnant to try to get him to marry her, to lead what I guess she thinks is a normal life.

I believe the Maryland law says "under the age of 14" or 14 and 15 when the actor is 21 or over. It would appear that neither apply to your son if he was 19 and she was 14.

I'm no expert on custody, but you guys probably need to seek real legal assistance on both points.

So, who should get custody...the underaged mother of the child, or the adult who impregnated the child...?

What a dilemma!
