per say someone accuses you of stealing merchandise, and decide to pursue w/a search but find nothing? can you still be charged ?

There has to be some evidence of a crime in order for you to be charged. For example, if they search and find nothing, but have you on video stealing the goods, it does not matter that they found nothing in the search.
