Telephone harassement


I am in Boise Idaho ADA county

I had a guy that ripped me off on a car deal he was a friend for 20 years blah blah blah ( if you need more info just ask I am trying to keep this short ) I called him 6 or 7 times in an attempt to collect my money he said to stop calling you are harassing me so I stopped calling him. I emailed him 3 times he called the police who in turn came to talk to me they said not to call him anymore so I didn't. 9 months pass and he posted an ad on craigslist saying I had a free car with my name PH#'s and address my phone rang off the hook and I had people coming by my house for hours. I emailed craigslist and had the ad taken off he put up another one with the same info and result. I emailed craigslist again had the ad taken off and emailed him to tell him to knock it off. He put up another same info and result I emailed him again and told him to cut the ****. He called the police and I received a misdemeanor citation for telephone harassment. The X friend is the complaining party with the officer as the witnessing officer on the citation. I have the information about his ads from craigslist saying he is the one that posted them. now for the questions. I have no criminal history at all I have traffic tickets but no DUI's or anything like that. How should I handle the telephone harassment citation and what would the penalty most likely be? should I go after him for impersonation for the purpose of harassment because of the ad's or should I just let that go and put this thing to bed. He also called the police and said that I was cooking dope in my house the police came out to talk to me I offered to let them search my house they said that they had no reason to and left. He then called the EPA and said that I was painting cars in my house which I was ( I painted his car and one of mine ) but I wasn't when they came over and I would not let them look in my house so they left. obviously there is more to this story but I tried to keep it short. Anybody have any thoughts on this?

When you go to your hearing, bring the craigslist ads. File a civil suit for harassment. If you choose not to go this route than pay the fine and move on.

Do you have evidence proving he was the one who was submitting the craigslist ads?

Yes the Craigslist reports have his email and IP address along with the copy of the ad's he posted. About how much will the fine be on the citation I got? is this something I could go to jail for? and will this go on a permanent criminal record or is it about the same as a traffic ticket? Should I hire a lawyer and get it dismissed then sue him for my legal fees? What will filing a civil suit against him for the ad's do and if he wins can he come after me for his legal fees. I just don't don't want to commit financial suicide over something stupid like this.

i strongly recommend you at the very least consult with a few attorneys.

honestly, what you SHOULD have done was hired an attorney to write up a cease and desist letter to stop posting your personal information.

jail time? i highly doubt it. most likely there are fines, maybe probation.

I just talked to a family friend / lawyer he said to have him cited for the false impersonation and to get the police report on the dope cooking thing if there is one. He said to see if the city will press charges against him for filing a false police report to help the state see that their witness does not much value. He said what will most likely happen is the prosecutor will see that this is just a pissing match and will not want to get in the middle of it. He also said to plead not guilty and on the telephone harassment and request a jury trial for the leverage. Does anybody have any thoughts?
