My husband(no living with at the time) was charged in Texas on 2 counts of having sex with a 15 year old. He had known the girl for a number. The mother had always told him that he was the girls father and the girl always called him Daddy. While living in Alabama he discovered that Texas had outstanding warrents on him for the alleged incidents. He was extradited back to Texas. He was incarcerated for about 9 months and then told if he didn't do a plea bargain, he would get 60 years. One legal aid attorney talked to him and told him that the DA was paying to get him convicted. When he got down to the last attorney , he requested another attorney. He told him that he couldn't have another one. This attorney initialed all papers with my husbands initials. He never signed any of the papers. He was pressured to take a plea bargain so he took the least amount of time he could get which was 25 to life. They took an old felony conviction from 1974 in Alabama so they could sentence him as a habitual offender. He was never arraigned in Texas on the charges. There was no physical evidence of the sexual occurance. They taped a testimony of the girl. The investigating detective said it was his opinion that he was guilty and that the girl was capable of knowing the truth from a lie. She also had had sex with at least one other man around the same time. She was supposed to have been raped by him, but he has never even been arrested. The transcript of the girls testimony disappeared out of his cell. When he went to court for sentencing after 9 months, the judge told him that if she were him she would file an appeal right away and that he should send it to her. He did this and she sent the appeal on to the appeals court. What are the chances of getting anything done to help him. An angel he obviously isn't, but it looks to me like he was taken in this case. He says he never touched the girl.
