What is the name of your state (only U.S. law)? Texas
I'm trying to help a friend who is still struggling with this issue. Her ex-husband forced her son-6 yrs at the time-to tell law enforcement that he was molested by her then-husband so he could punish her and gain custody of their 2 sons. (there are many more details...) Her then-husband was convicted, her ex gained custody. Her then-husband committed suicide as a result of the false conviction. That was 15 years ago.
Her son has now recanted his testimony to her and told her and his brother the truth about what his father did to hurt their mother and it caused the death of his stepfather. He feels horribly guilty, as well. Is there any legal recourse for my friend to clear her husband's name? They had a son who is now 11 yrs and it would mean alot to relieve her older son of the guilt and clear the name of her younger son's father.
