What is the name of your state? Massachusetts.

There is this person in the neighborhood where I live who is autistic. He was diagnosed since age 3. He has no criminal record and is a great kid. He has overcome so many obstacles that most autistic children never overcome. Unfortunately he had a nervous breakdown. He lives in a very stressful home environment. His brother is bipolar and one night his brother was fighting with his girlfriend and he tried to stop his brother but couldn't stop his brother from arguing with his girlfriend. He got very upset and his mother told him to go take a walk. Well he ended up vandalizing a car (smashed the back windshield through with a shovel). His mother, me and my roommates heard him screaming outside and went out to stop him. We also called the cops for his mother. He wasn't arrested by police because they new he was autistic instead the ambulance was called and he was sent to the hospital. The police told his mother not to worry about the car and let the owner just call the police and take care of it through their insurance. The mother told the police she had no problem paying for the damage and gave the police her number. It's been about 2 weeks since the incident and the car that was vandalized never moved from the spot where it was parked and the owner never came out to at least cover the back window with plastic since it has rained & snowed here since this all happened. Well the other day a policeman came back and said the owner of the car wants to prosecute. The funny thing is the owner of the car has not done anything to protect his car from the weather or even move the car from the spot where it was that night. The interior of the car has most likely been damaged and the damages beside the cost of a smashed windshield are greater now. What should this mother do? Should she call the police and ask them if they should tow the car? Not do anything and just let the inside of the car become more damaged? It's obvious that the owner of this car is not worried about his car and is looking to get some $$$$$ or a new car perhaps. We have been taking photos of the car with a digital camera that shows the date so their is evidence to show the owner has not done anything to protect their car from further damage.
