Wrongfull Accusation

I've Been Doing Daycare For Seventeen Years And Have Never Had And Problems Or Complaints From Any Of My Children. But One Of My Kids Whom I Had Been Taking Care Of For A Long Time That Has A Bad Backround Of Lying,steeling From School And My Daycare Has Accused My Son Of Molesting Her. I Know For A Fact That Could Not Have Happened Or Ever Did Happen. But She Was Consistant In Saying That He Did And Everytime She Would Tell Her Story It Would Have Something New Added Each Time And Turn Out Different From The Time Before. And Because Of This We Ended Up In Court. My Attourney During The Cross Examination Caught The Little Girl And Her Mom Lying Twice. Then When It Came To Be The Police Officers Turn To Testify He Left And Never Returned. This Is Not Surprising Because Earlier In The Case He Had Made A Bogus Report About My Son Saying That He Was Over 21 When In Reality My Son Is Sixteen At This Present Time. He Also Had Mentioned That My Son Had Been Taen Into Custidy Which Never Happened. Also He Had Said That She Feared My Son Which She Had Never Said. Just To Add To This She Claims That This Had Happened 2 Years Ago. And After All This And Even If I Never Thought This Of My Son My Intentions Were To Find Out The Truth Rather Then To Protect Him In Which Case We Voluntered To Go Through With A Lie Detector Test Another Thing That We Voluntered To Do Was To Give Up Our Computers For Examination Because In One Of Her Stories She Had Mentioned Seeing Inapprpriate Material On Our Computers. Maybe Out Of All Her Stories This Was Maybe The Computer Was Our Main Resource To The Truth Because She Was A Student Of A Certain Teacher Who Had Been Arested For Child Pornography Found On His Computers And What Makes This Even More Believable Was That She Was Kept One Day After School In His Class Without Notifying Her Parents Which Her Mom Admitted To. But I Guess For The Investigator Who Could Have Cared Less For What We Wanted To Do Or For That Fact Say Because In His Mind The Conclusion Was Already Made That My Son Was Guilty Therefore He Wrapped Up His Report Without Out Even Listening To My Sons Side Of The Story. The Witnesses Whom Were At The Hearing Testified And All The Stories Matched Eachother And All That Was Spoken Of My Son Was Nothing But The Best Because Of His Honesty, Integrity, And Of Him Being An Honor Student With A 4.2 Gpa. And After All Of This The Attourney Who Represented The Liscensing For The Daycare Providers Suggested To The Judge To Revoke My Liscence Because To Him My Son Was A Threat To The Children. And For My Sons Innocence He Scheduled Another Hearing For October The 19th. Since This Is Not A Trail Case And The Judge Is The One Who Makes The Final Decision And Said That It Would Take About A Month And A Half To Two Moths To Get The Final Results I Was Wondering What Can I Expect From The Judges Decision???because I Can't Trust Anybody Right Now And My Daycare Put Food On The Table For My Family And For It Being Out Of Business For This Long Has Put A Major Strain And Major Stress On My Whole Family. Is There Any Organization To Which I Can Conplain And Or File A Suite Against The Investigator For Lack Of Investigtion To Actually Find Out The Truth And Liscencing Supportig And Excepting The Investgators Conclusion.?? I Will Not Give Up On This And Except Any Decision But Innocent Because Thats What I Am...i Was Wondering How I Can Make This Go Faster And If Ther Is Anyone Who Can Actually Maek A Serious And Honest Investigation To Find Out The Truth.

Your post has to be the very hardest thing I have ever tried to read here. Frankly, I got lost in it and didn't even finish.

Paragraphs would help and get rid of those darned capital letters for the start of EVERY single word!

Leave out the melodrama and perhaps repost.

My response:

It's as if people forget their English classes when they come to this site. They just type one, huge, stream of thought and then expect others to muddle through.

Weren't people taught how to use PARAGRAPHS?

Can you please post your state and use paragraphs? In most states a liscensed daycare facility would be closed pending the outcome of the investigations of sexual abuse charges if a judge were to order an injunction, that sounds as if that happened. Was your son charged? Have you retained counsel? BTW his IQ or grades has no bearing on his opportunity for inappropriate sexual contact. Witness acounts by young children may change over time as they are repeatedly interviewed. Lie dectector tests may not clear your son not do they necessiarly reflect his mental status. After an accusation is made people will still believe what they want to believe, even when there is no evidence of the crime found.

Why is it IMPOSSIBLE for your son to have done this to that child? I know you cannot as a mother believe your son could do such a thing, but it does happen.

<How old is the girl you take care of?
<what kind of explanation does she give of the abuse... what language... ie-my children were abused by their father and at 2 years old my daughter said "daddy touched my poopy"... and used the explanation "pee pee finger" to describe his penis... If the child is young, she may only be remembering bits and pieces of this...

I know you don't want to hear this, but you need to open your mind to the possibility that it COULD have happened... it may not have, but it COULD HAVE!

It may depend also on the state and local policies.

In my region we had a daycare (run by friends of ours) where a small child (5 years old) accused the daycare provider's husband of molesting her on several different occasions. The criminal investigation revealed that the molestations did NOT happen (the "suspect" was not even present in the home during at least two of the 5 incidents), and the child even admitted to lying during an administrative hearing. However, because a psychologist believed the child had been molested - though even he couldn't say with certainty it happened in the daycare - the judge said he had no choice to but to sustain the license revocation.

The owner of the daycare had already spent about $15,000 and had no income for 6 months when they got to the Administrative Hearing. To appeal they would have to spend at LEAST that much again and they were told by two local attorneys that the chances of prevailing were slim.

As we discovered, even an unproven accusation can be sufficient to put a daycare provider out of business ... at least in CA.
