    Question Does CVC trump county municipal code?

    What is the name of your state (only U.S. law)? CA

    My local county code has stricter regulation of horn use than the CVC. Which regulation carries more weight?

    CVC:

    Use of Horns

    27001. (a) The driver of a motor vehicle when reasonably necessary to insure safe operation shall give audible warning with his horn.

    (b) The horn shall not otherwise be used, except as a theft alarm system which operates as specified in Article 13 (commencing with Section 28085) of this chapter. Amended Ch. 993, Stats. 1977. Effective January 1, 1978.
    County municipal code:
    6.7-.--- Enumerated noises.
    The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this chapter, but this enumeration shall not be deemed to be exclusive:
    (1) Horns, signaling devices, etc. The sounding of any horn or signaling device on any automobile, motorcycle or other vehicle on any road or public place, except as a danger warning; the creation by means of any such signaling device of any unreasonably loud or harsh sound; and the sounding of any such device for an unnecessary and unreasonable period of time;

    This query is regarding the use of keyfob lock devices that honk the horn as an indicator. Is the CVC code a valid defense for the application of the local municipal code regarding noise?

    A local municipality can have stricter laws than the State-wide Codes.

    (For example, under the Health & Safety Code, a mj pipe is not paraphernalia & is not illegal; however, many cities and counties have ordinances making them illegal within their jurisdiction).
