We have an idiot among us. A firefighter/EMT/medic took a picture in the back of ambulance. In that photo was the unconscious patient (apparently identifiable) that was being transported. I do not know if the inclusion was intentional but so far have found nothing that would infer that is was. The fireman put the pic on his myspace page.
So, from my understanding, this is a violation of HIPAA. I also understand that there is a criminal component to HIPAA as well as the civil penalties although rarely used.
So, the question is: Is the firefighter's action egregious enough to warrant criminal charges? Does the fact it was unintentional alter the possibility?
