Question

Abandoning Products & Product Liability Laws


What is the name of your state? Illinois

Our company has recently withdrawn its product liability coverage on vehicular lighting
products that sit in a warehouse that it couldn't sell. The products would cost more money to remove them from the warehouse than they are currently worth.

Can the company abandon the product and, then allow the warehouse to try to sell it without incurring any product liability problems? And, could this be done through a legally effective notice to the warehouse? The company's name is currently on the product packaging, while patent numbers are on the products. What needs to be done?

You can't "disclaim" product liability. What you are proposing is impossible.

Frankly, once the warehouse sells the lights (with OR without your permission), you can be held liable for any accidents involving them. (Doesn't mean you'll be found guilty, but you can bet your last dollar your company will be named as a defendant in any lawsuit).

Personally, I'd advise either destroying the product and taking the write off, or else getting a new insurance policy which covers the lapse since the old policy expired. Anything else potentially leaves you open to an uninsured lawsuit.
