aborted take off


What is the name of your state? WV incident happened in CA

I guess each case is different as is mine. I will just give details.

On the way back from CA on vacation the passenger jet my wife and I was on had some mechanical difficulties before take off. After a few hours on pad we attempted take off which had to be aborted during take off. I told stewards I was ill and paramedics checked my blood pressure and I was rushed to local hospital. After a few hours there I was diagnosed with a ‘stress reaction’.

After receiving all my bills and expenses I presented them to Delta for payment. It was about $11,000.00. I figured if they would pay for this I would not claim any other monies.

While talking to Delta rep he asked me if I had insurance. I said no, but actually I did. I thought the question was unfair. I was not willing to let Delta off just paying for my expenses (motel/food/taxi) I know in auto accidents that the plaintiffs insurance cannot be a factor in determining liability. I asked for payment for all of the fees, not just for the one’s my insurance did not pay.

The rep told me that they had to directly pay the hospital/paramedics, etc. and could not pay me directly. When I refused to sign a release, the Delta rep called the hospital and found out that I did indeed have insurance and is accusing me of trying to scam them.

I had no intention of scamming them but just wanted compensation for what I had been through. At the time I didn’t want to go through a long litigation, now the rep is asking to speak with my lawyer, which I have not yet obtained.

You may want to. If Delta put in a claim to their insurance and you lied... can you say fraud?

If your insurance company paid your bills, then they must be paid back before you get to put ANYTHING in your pocket. You attempted to defraud the airline AND your insurance company by claiming that you paid the bills out of your pocket. Lying never did anyone any good. Bad ideas all around. Insurance does not affect liability determination but it DOES affect where the payment needs to be sent.

You had a panic attack, which is NOT the fault of the airline. I agree you should not expect to get ANYTHING from them and if they offer you any kind of compensation you should consider yourself lucky. Your reaction to a non-dangerous situation can't be blamed on anyone else. Even if you'd had a real heart attack on the plane, you still could not have held the airline legally responsible for it. Go ahead and talk to a few lawyers, I would bet you won't find one willing to take your case.

Wow. I've had panic attacks my whole life. Pretty regularly the past few years too.

Not a single one has cost me $11K+. I've also never thought SOMEONE ELSE needed to pay for one of them.

You notice that OP also expected the airline to pay for his accomodations and living expenses for his extended stay in the area?
