abused elder died before trial


What is the name of your state? ca
My father was being abused by my brother,he was arrested on the charge of battery of a person, my brother failed to appear at his arrainment, and within 30 days my father
died, and my brother has not been rearrested on the the failure to appear warrent .
there were pictures of injuries the victom sustained. sincemy fathers death, there is now no witness to the incident and i'm told that charges will now be unable to be proven, against my brother.

will my brother then get away withthis conviently because this has been a terrible wrong that did'nt go away or not happen just because my fathers health was so fradgile even at the time of the attack that he didn't live long enough to appear in court for the prosicution?

your oppinion and statutes and case law findings on this matter would be so helpful..

A representative (administrator) can sue your brother civily on behalf of his estate. The burden of proof is lower than in criminal actions. Of course that is assuming your brother has money or assets. You have very little control over DA's decision not to prosecute.
