Assault, and no justice??


What is the name of your state? Illinois

Last August 12, 2006 I got in a fight with a girl, over some touchy issues about iraq (my dad is over there and she said its peoples own fault for going over), and the soldiers going over, and we were both drinking, and the fight elevated when she got in my face yelling so I yelled back in her face til she clocked me on the head with a beer bottle and I wasnt completely dazed and defended myself and we fell to the ground and I lost consiousness probably for ten secs. and then the fight continued.

I went to the ER, and the cops were dispatched to the scene, and the guys there, my supposed friends, said that no one had been there and nothing had happened. Mind you this was an illegal drinking party, with people 21+ yrs, the girl that hit me was 23 ish, and I was only 20 at the time, and got a consumption ticket when I got to the hospital.

So weeks went by, I went to the town she lived in and found her in the year book at the library, and was able to give the police her name, and they couldnt find her, shes from a different town right outside of mine. Then I see her in a verizon wireless, and give the cops her license plate, they then say the license plate was no good.

Then months on down, I ask them what is going on, why havent charges been brought to this girl? And they told me that when they went to the house that it happened at, that the people and the renter were uncooperative saying that nobody had been there, and thats why nothing was charged.

I don't see how this is a legit answer. I didnt know the girls name at the time of the fight, but was able to provide it later on.

The girl should have a warrant out for her arrest for deadly assault with a weapon, I was sent to the hospital a bloody mess, and got stitches in my ear/head, which has left a bumpy cartilage, and I cant wear sunglasses at all because of the pain, and 6 months later was still on tramadal and was given two cortizone/and something else injections in my ear. I know someone who spent 4-6 months in jail for hitting someone with a beer bottle.

I talked to a lawyer and he said it's hard to sue anyone that is a nobody with nothing, true, but why didnt the police press charges still??

My lawyer also talked about suing the home insurance, but he is a renter and there was a new law in illinois that you cant sue the landlord for what the tenant did because the landlord didnt say it was okay to have that under-aged party, nor was he/she there.

I've come to some terms with this and sucked it up, I was in the wrong to be at an underaged drinking party, but it still doesn't give someone the right to hit me with a glass bottle because I was there.

I don't see any justice in this...any ideas? This is the second time something has happened to me where the police have brushed it off, the first time me and my sister got in a fight where she kicked me in the face and all over my body, again I had been drinking and so was she, but I didnt get a illegal consumption ticket that time. My face was swollen out the side, and pictures were taken of me both times, but no charges followed up.

That was actually the second time my sister had gotten away also with battery, after she broke another girls nose, the girl filed a report and nothing happened.

I think our justice system is completely screwed up here in pekin, illinois.

I am thinking about consulting with another lawyer about this, about the reasons the police did not set a warrant for the girl, it was also hard for me to provide information since I had to call an investigator of the police station, who never answered his phone, and the officer on duty was never available to take information, who was the one who took my information when i was in the hospital. Any suggestions?

Get off the alcohol, grow up and move on. You just can't get over the fact that you got your butt kicked by a female.

Sue in small claims for medical costs. Doubtful you could recover enough to interest a lawyer.

twice, once by a chick with a bottle, and once by a chick that probably used to fix his bottle. LOL unless, of course, he is a she???

There's some kind of thingy somewhere online that analyzes any written paragraph and can tell if it was written by a male or female, based on syntax, grammar, sentence structure, attitude, etc. My internal analyzer thingy is definitely thinking "female".

thanks, i guess, for the replies...im a girl btw, and havent drank since last november, and am back in school to become an RN.

ozark-you're right the medical costs wouldnt and isnt enough to interest a lawyer...im not so much worried about that, because my dads insurance covered it completely -thank goodness-, i just didnt feel justice was served against the girl that assualted me.

i wanted to know what others thought, was the reason i posted this, i can handle being told to "get off the alc. etc.". Hard lesson learned, *sucking up and moving on* my life and myself are better in every aspect than that girl that assualted me anyways. especially now.

i wanted to mention, what sucks the most is that there is a ripple in my cartilage now, and whenever i put on sunglasses the pain goes through my ear and head, and just reminds me of the whole night, and how she got away with assualt.

im just glad i only need my glasses to read and that i am not a big sunglasses wearer...but when I do run across a nice pair, it just sucks.

So your health ins. paid for it and your only perm. damages are you can't wear SUNglasses? But you said you need to wear regular glasses to read??? Why can't you wear contacts?

It's good you are finally thinking about growing up some and getting off the alcohol. Geez, what are you upset about? Because some chick and your sister hit you and got away with it? Stop getting in fights and you won't get these problems....
