Question

Assulted with a hammer


Hi, I'm in San Diego, CA.

Recently I was assulted by my roommate. He attacked me with a hammer and as a result I have racked up $30,000 in hospital bills and missed work, which I definatly cannot afford.

The attack occured when I confronted the roommate about stealing. An ongoing problem, the roommate would take anything that was in common areas, food, liquor, cell phones, movies.

The landlords had been told repeatedly that the roommate was a mean drunk and a problem in the rental but they chose to ignore the problem.

The roommate had been on a really bad bender this day and broke into another roommates room and stole two cell phones and a cordless phone, then when confronted he was so drunk he was barely intelligible. The police came but did not want to deal with him so they called paramedics and the roommate was taken away. Some how he was released. I was out and when I came home I found items missing again and went to confront. It was a set up and I fell for it.

What I want to know is this;
First, do the landlords have any responsibility for the safety of one tenant from another. They were given multiple warnings about this roommate yet refused to acknowledge the problem. These landlords care only about rent and rarely show at the property for repairs and never for mediation.

Second, are the police at fault for not dealing with the original situation. It seems to me that after B&E, theft and extreme intoxication that the roommate should at very least been in lockup over night. Myself and two other roommates told the police exactly what would happen if they did not take him away.

I just feel that someone is culpable here. I don't like dealing with hypotheticals but I am more than certian that this attack would have never come had either the landlords or the police acted appropriatly.

Do I have any legal grounds for suit against either?

How about a suit against the person who actually caused the damage?

The guy has mental issues and absolutly no money. He gets social security disability for ADD or something.
He is the type of person the public should be protected from.
