Box Hit Head


What is the name of your state? AZ
I was in Wal Mart 2 months ago and a box that was #64 that was on an endcap fell on my head and arm. Since they have called and admitted it was the fault. I have had xrays, mri, physical therapy, and now I'm going for my 2nd epidural shot in my neck for pain.Pain pills do me know good the physical therapy was massage therapy and ultra sound treatment. I'm in constant pain. The claims dept said they would pay for all related medical bills and offer me a settlement, can I reject the settlement or must I take the first offer, and what should i excpect I know all cases are different, my medical bills so far are about $3000.00 but some idea so I'm not taken for a ride. Should I hire a lawyer? What are my options?

As to your question :
The best thing to do is get a lawyer. There are alot of them that will wait to get paid until you settle. I think in California for a personal injury you have up to a year from the date of the accident to file with the courts. In any case I would not take the first offer they make you. Remember if you decide to go to court to ask for open medical, in case of any future pain relating to the injury you can see a doctor and they will have to continue to pay for the visits.

If you don't know the law, don't respond. You'll do more harm than good.

All this idiot has to do is re-write his post, like a normal human being. Then, we'll answer him/her with the CORRECT law.

What is with everyone attacking people on this sight? I am not dumb. I recently went through the same kind of law suite and I only gave her the same advice as my attorney gave me And yes he is a VERY good attorney. We won BIG!!

My daughter had a display shelf fall on her in J.C.pennys the shelf fell on the both of us but my daughter had to have stiches on her head and nose. She gets headaches now. They also tried to settle with us but the attorney we found took out 15% of the settlement for his payment, plus we also have open medical for my daughter.

This is not a typical result in any personal injury lawsuit, assuming you are telling the truth of course. Normally the attorney will charge anywhere from 33-40% of the recovery plus expenses. If your daughter was a minor at the time some states restrict fees on cases for minors. Normally insurance companies do NOT leave future medical expenses open, nor do judges.
