Broken glass in Night Club


What is the name of your state (only U.S. law)? FL

I have been told I should contact a lawyer to see if I would have a case to cover medical costs for an accident that occurred last Thursday at a concert held at AKA Lounge in downtown Orlando. There was broken glass under a table that sliced my foot on while going to sit down. I was wearing shoes, it cut into the side of my foot that was exposed. It caused me to need 8 stitches. When the injury happened there was very little assistance (they offered band aids), the staff was rude (getting on to me about wearing sandals in the bar while I was bleeding everywhere) and they were quick to try to get my friends and me out of the bar as quick as possible. They kept telling us we needed to go while my friends were trying to bandage my foot in the bathroom, basically kicked us out. My foot was pouring blood and I had to be carried out by a friend. I missed the next day at work, ended up with a sprained foot most likely from trying to hop while being half carried by my friend through downtown Orlando on my bloody foot. I am on crutches now, which makes it very difficult to take care of my 8 week old baby. Would I have a case against this bar?

It's not going to be a clear cut case of negligence, if there just happened to be one stray piece that got missed when a dropped drink was cleaned up. But go ahead and talk to a lawyer. One will tell you whether there is a case. If he asks for any money up front, that means you don't have a case.

How long had it been there? Is it reasonable that they should have noticed it? I would guess not since you didn't notice it either. Can you prove that they had been alerted to the presence of broken glass? It's a night club, that means it's DARK and it's LOUD. It might not be negligent if they simply did not hear it break or see the glass that had been intentionally hidden under the table.

I am not sure how long it had been there. They were holding a concert that started about 3 hours prior to me finding it with my foot. I am more upset at the way they handled it after I was injured, and would not consider suing if not for that. After my friends helped me into their bathroom, they went for help from the staff, a person that works there came in with band aids and began lecturing me about the shoes I was wearing. One of my friends began getting sick at the sight of all the blood pouring out of my foot (there was a lot), and at that point the same staff member told us we needed to leave. They did not offer an ambulance, make sure that someone was okay to drive, they weren't at all helpful aside for a few band aids that did nothing given the depth of the cut.

So, I guess I am wondering if the way they handled the situation makes a difference on whether or not I would have a case.
