| Not sure if this would apply to you,but,Back in early 2004,in NC,my husband worked for our landlord,cleaning and repairing rental properties.One day they took a load of trash off to the dump,when my husband stepped off the back of the truck,he slipped,his foot got hung up between the concrete wall and the dumpster,my husband went on over into the dumpster,his foot didn't,breaking his leg in 2 places and popping his ankle out of socket and twisting his foot halfway around so that it pointed to the side and outwards from the body.He required 2 surgeries and had 3 casts in 4 months.
We waited patiently for 2 weeks for the county insurance investigator to finally go to the site and investigate.A week later we were told the county wouldn't pay his medical bills because they thought it was his fault.That made me mad for several reasons:the investigator waited 2 weeks before he went to the dump to ask questions and take pictures.Of course everything will be made perfect there by then.My husband wears a size 13 wide workboat,why was the dumpster not flush against the concrete wall,there shouldn't have been a gap that big there to get a foot in.We have the dumpsters where you drive up on a concrete ramp,and throw your garbage down into the dumpster the size of a semi trailer,and when it's full they hook it to a semi and pull it away.
So I called a few personal injury lawyers and was told that there is a law in NC for personal injury,that if you are found even 1% at fault,the case will be declared no fault,and you will be stuck with all the fee's etc and no one would take the case.We were told it was possible that we could sue our landlord in an on the job type injury,but we never did.
Even though the doctor told my husband his leg is healed,he still walks with a limp,it still hurts,and from right above the top of ankle to the top of foot is still twice as big as his other leg. |
