Broken Leg on Unsafe Soccer Field


What is the name of your state (only U.S. law)? Ohio

I play soccer for the University of Dayton Men's Club soccer team, and while playing a game about three weeks ago I broke my fibula in 2 places. I wouldn't normally think of any legal implications from this, but a few circumstances raised some questions. Normally we are required to sign a liability sheet before playing on a field; there was no sheet. Also, the gate to the fields was locked and we were scheduled, so the teams had to hop a tall fence to get on. We were forced to play on a youth field covered in holes and ruts. The doctor believes I broke my leg from twisting it in one of the holes, as no contact was made. Please let me know your thoughts.What is the name of your state (only U.S. law)?

"Forced"? Not having another place to play does not "force" you to play there. Think of assumption of the risk for the patent problems on the field.

Let me get this straight, the owner of the field puts up a high fence and locks the gate and you decide to violate that clear do-not-enter warning because you were "scheduled" to play and you think it's their fault you got hurt?

My thoughts are that there are so many problems to a lawsuit that if you file one it will be considerd frivilious and you will be subject to countersuit for malicious prosecution.

The only reason I thought there could be implications is the fact that we play on a field in the park regularly. Usually we sign a form. This day the park worker was late, no forms were signed, and because of a problem with the goals we played on a youth field. I was told this never should have been allowed and that if there was no suitable field we should not have been allowed to play. We didn't break into the park, we just hopped the fence to get on the fields to warm up, as the park attendant was late.

Here's a thought - when the attendant was late, you could have WAITED FOR HIM rather then trespassing onto a field which you would not have been allowed to play on, if you'd followed the proper procedures. You are responsible for your injuries.
