brother burned in jail


What is the name of your state (only U.S. law)? CA

My brother recently spent 90 days in county jail. He volunteered to work in the Kitchen and was burned pretty badly (2nd and 3rd degree burns on his arm) while cooking. His forearm will be badly scarred. He may need further medical attention. I think he should talk to an attorney about suing the county or at least getting them to pay for his further medical treatment.

He has drug problems, thus his incarceration, and I'm worried that he will not take care of his injury due to drugs, lack of money and lack of insurance. He's currently living with me and is clean, so far. He is in a lot of pain due to the burns, and the fact that he has no pain pills. I'm not interested in getting him any pain pills, but I think he needs some medical treatment.

I'd like to get the county to help him get medical treatment, but they have so far refused. Even though he has drug issues and has been in jail this seems like pretty shabby treatment. Does he have any recourse?

He very likely will qualify for Medicaid that can help him get drug treatment and medical treatment. It is good that you are helping to support him; I hope he is able to stay clean and get his life back on track.

OP, why do you believe that the county was responsible for his burn? What did they do, or didn't they do, which caused the burn?

He was working in the Kitchen and pulled a roasting pan down off a shelf. The roasting pan was loaded with hot grease and as he pulled the pan down the grease spilled onto his arm.

His PO thinks he should file a lawsuit.

Again, what did the county do, which caused this accident to happen?
For example, had this same situation happened in YOUR home (he was cooking, he pulled a pan from the oven, he spilled grease on himself) would YOU have been responsible for CAUSING the accident?
Had it happened in his won home, who would have been responsible for CAUSING the accident?

Does workmens comp apply to jail jobs?

I don't think that the county pays into workmans comp for inmates.
