Can I Sued

I reside in Queens, New York
My question is:


Returning from vacation I boarded a taxi at Penn Station. The driver said he did not know his way to Queens, I said I will intruct you. About 8 blocks down he complained of having car trouble, I ask could you please haid another cab with no result, I told let me see if I could also with no result. he inturn put my luggage out. I had to take train pulling luggage I have a hip injury as a result I had to go to hospital to find out that one of the screws had broken. Now I have to have surgery to fix it. Do I have a case and who do I sued.What is the name of your state (only U.S. law)?
