Can we sue for 3rd Degree Assault?This big guy that happens to be a manager of a security company injured my girlfriend because she stood up for some people that almost got run over by his SUV. We filed charges, but she never went to the hospital to get medical treatment. Can we sue the guy for assualt and making us miss our flight the next day? |

| No you can't sue him for assault. Assault is a criminal charge. |

| Assault is a tort as well, as is battery--which is more likely what you would sue for. However, your damages are not that great. Proving the tort may be hard, proving up the damages would be very hard.
