Child Fell Jumping On Bed?


What is the name of your state? PA

My 6 year old son was with his Dad (NCP) for his weekend visit. They went to his Dad's friends house, married couple with 2 kids. I get a call from Dad to meet him at the ER with sons insurance card. I arrive to a mess, bleeding everywhere. My son eventually received 11 staples on his head, 2 seperate lacerations on either side of his head??? No one has actually explained how it happened exactly, and how both sides were injured.

In the room when it happened was the male homeowner. He said the kids were jumping on the bed. He told them it was the last time they could jump. He says my son jumped, got his foot stuck and fell dangling from the bunk beds, hitting his head.
Originally, at the hospital, Dad said he was jumping over a box of toys and fell.

My insurance sends out accident report forms for injuries such as this. They ask for how, when and where it occured.

Who is at fault here? Dad? The homeowners? I would say my son is at fault for jumping, but he was permitted to.

This sounds like a childhood accident that happened due to kids being kids and roughhousing, not grounds for a lawsuit. The ER copays should be paid according to your normal agreement. It did happen on dad's watch, so it would be reasonable to ask him to cover them, but probably not worth getting into a big fight over.

Scalp wounds do tend to bleed a lot so it may have looked worse then it is.

It's possible that the homeowner's insurance would pay for any uncovered medical bills as well.

What is the prognosis for recovery? Have you scheduled a follow-up with the child's physician? Is there a head injury other than the lacerations?

The follow-up appt. is tomorrow just to be sure there is no infection or swelling. Then I have to schedule, in about a week, another appt. to remove the staples.

There shouldn't be any uncovered medical bills by my insurance. But, with the incident report I fill out for my insurance compnay, they may go back to the homeowner's insurance to get reimbursed.

No concussion. Never passed out or threw-up. He should heal fine, there will be scaring, no more mini mohawks or buzz cuts.

I am just upset that he knowingly let the kids do this, while he was in the room, and because of the hell my son went through, being strapped to a board and held down, stapled, with no Litacain. I had to leave the room I was so upset at the sight and his cries.

I am pretty ticked at the ex too. They still can't even figure out what he actually hit his head on nor how both sides were split.

The hospital did say they bleed alot too. He looks like Frankenstein with all the staples, so that actually makes it look worse.

I wish!
He hates blood, freaks at the site.
We can't wash it yet so it's all dried in his hair. He won't look in a mirror. It will be 48 hrs. tonite, so we can wash it then. Plus, he's ticked he can't run around and play and is missing baseball.
