Closed Thread ""fall in mall parking lot"To kmhall: Your post is closed - What is the name of your state? ohio Last November my son was entering a movie theater at a mall and slipped and broke his arm. He has had one surgery and one more is planned. The parking area in front of the theater is designed so that you park your car perpendicular to the theater. There is a lane of traffic between each parking area and then a grassing landscape island that seperates the next parking area. There are no pathways designed in the islands. Patrons walk thru the islands and parking areas and enter the theater. The only other option is to walk in the traffic approximatly 50 or 60 car spaces depending on where you are parked to the mall sidewalk and then walk back towards the theater. We visit this theater frequently and walking thru the islands is the common way patrons enter the theater. On this evening my son had to park three islands out as it was very crowded. It had been snowing and the parking lot was plowed, however the islands had not been cleared. There were clear "pathways" every 2 or 3 feet thru them from previous patrons and it was here that the snow next to the curb of the island gave way and my son went down. Is the mall or theater responsible for keeping a know pedestrian pathway clear and safe. We went back the next day and took pictures of the "pathways" thru the islands as well as patrons walking thru them to enter the theater Answer: Sorry, you have not hit the deep pockets lottery.
