Denied Claim... Adjuster says "No liability"


What is the name of your state? California
Denied Claim... Adjuster says "No liability", for personal injury.
This despite Insured stating on 3 separate occasions, "I caused the accident".
Adjuster states "excited utterances".
Question : How can I get access to the Insurance Company's Case file ?
Specifically statements made by Insured & witness.
Not represented by attorney.
Thank you.

Sue the other driver where you will be afforded the use of subpoena powers by the courts.

Other than that you can say "pretty please".

My response:

Subpoena power or not, our writer will NEVER get the adjuster's file or records. "Work-Product" exception. Sorry, you'll just have to prove your case based upon the facts of the collision and witnesses.

The fact remains, the accident may not, in fact, be the other person's fault. This is why we have courts.
