Question

do i have rights to sue?


Pennsylvania
Last year 2006 my daughter passed away at 7days old. Due to lack of money I had her cremated. This lady Debra Wagner went to the funeral home and got her remains without my permission and held her for a month. She made me beg on my hands and knees to get my daughters cremains. I have sued the funeral home and won. Now I was wondering to I have grounds to personally sue Debra Wagner for mental anguish. Not only did I lose my daughter to her passing away but I lost her again to the person who pushed me into preterm labor. She stole my daughter under false pretenses and stole my closure away from me. I was supposed to bring my daughter home not beg for her. Do I have the grounds to sue her and can I press criminal charges? I had tried to get the police involved but they said it was personal property and there for they could not get involved because it was to close and could go either way.....and i didnt have her birth certificate at the time to prove i was her mother

Who is this Debra Wagner person and what was her relationship with/to your daughter?

Talk to the cops to see if there was a criminal offense committed.

Talk to a peronsal injury lawyer to see if you have a case against the bad woman.

Make sure the bad woman has money before you sue her.

It won't do any good to sue her and get a judgment and then not be able to collect.

she has no connection to me she is the father of my daughter aunt....but she also wanted me to abort the pregnancy

I'm very sorry for your loss.
If she has no connection to you, how is it that the funeral home released your daughter's remains to her?

Also...your post is confusing....is Debra male or female?

she went there with a falsified letter saying i gave her permission then when i showed up to pick her up thats when i found out they had released her.

Actually, I think a suit for Intentional tort would put the fear of God into this woman regardless of whether or not she has money. A judgement can last for a long time

I'm not a lawyer, but I believe that means she intentionally inflicted emotional harm.

That she knew, or had reason to know, that her actions would cause harm to another party and proceeded anyone to act in such a manner to cause such harm.

oh ok....i want to fight her on my own i sued the funeral home and won on my own so i want to sue her on my own....lawyers around here where i live want to much or they ask me how can i put a price on my daughter and there is no price for her but there is a price for what debra did to me

You mean the funeral home settled out of court, and you received the $$.... or you won a court case, and collected?

Why did she steal your child's remains? For her brother (the babies father)

yes the funeral home settled out of court.....the babies father is debra's nephew .... she gave no reason to why she did it**************
