Domestic Violence - defendant plead guilty but I need help...


What is the name of your state (only U.S. law)? AZ
Back in May a a friend of mine was charged with domestic violence/assault after he was seen by several witnesses (including 3 third part witnesses who called the police) throwing me to the ground several times and hitting my head to the pavement. It definitely could have been worse but was still pretty gruesome. I guess I lost consciousness after the second time my head hit the pavement. I had several cuts, some of which I still have scars from, and was brought to the e.r. Anyway long story short I had a concussion, my medical bills added up to over $5,000 not to mention pain and suffering. I had to find a new apartment etc. The defendant plead GULITY already and based on the police report etc there is no question of his guilt. The problem is during this entire process I didn't have an address because I was forced to leave my home due to false (which can be proven as well)statements made by a friend of his which were later retracted. But the damage was already done, I had no way to collect the proper paperwork to turn into the victim's services department. He plead guilty and accepted his plea bargain before I was even able to get all of my bills together so now I as the victim am also stuck with all the costs associated with the assault. I've looked for personal injury lawyers etc but none of them seem to take this kind of case. Someone please help! I have no idea what to do and it's not fair I should be punished more because he can't control his temper So far, his actions have truly ruined my life. Any advice is very appreciated. Thank you.

You can sue the jerk in small claims court. At least you can get a judgement for your medical bills.

How do I go about that? I am truly lost here and the justice system isn't much help

You need to be your own best defender. Take charge and find a way. I'll give you a starting point.

However, be prepared for collection of any judgement to be difficult at best.

Lawsuits are not about justice. They are about MONEY. If you don't want money, then you shouldn't be thinking about suing. And people post here because they are thinking about suing. Because they want money, no matter how much they don't want to admit that to themselves.

Collecting on Small Claims Judgements


Yep, if you win in Small Claims (for which you SHOULD file), be prepared that you may not see a nickel out of him. See, that particular Judgement doesn't force the Defendant to pay. You would have to then file a motion to force the guy to pay. However, if the guy has no job and/or no money then the phrase "can't get blood out of a turnip" applies.

I Feel Your Pain!


I was just divorced in the state of Indiana on the 14th of September and even though all the findings showed his violent side, he got everything and got away with it all! He is a retired, disabled vet and he doesn't even have to pay me spousal support. He left me with post traumatic brain syndrome. I can not work or even ealk right now and it didn't matter to the judge!
