Family going to mediation

What is the name of your state (only U.S. law)? NM

The estate has a family representative and they are going to mediation on a wrongful death demand. Our case is strong however i was told i could not participate in the mediation only the family representative. This would be ok but i am concerned the family representative (my sister) is broke and may accept less than me.
