Fell On sidewalk and Fractured 5th metacarpal


What is the name of your state? NY
New York City.
My dad was walking on the sidewalk,it was at night. For half the block the sidewalk is one height for the other half it's higher. He fell and braced himself on his hand so that he should not fall on his head. He fractured the base of the 5th metacarpal and had surgey. Who is liable the city or the home owner? What can we sue for?

You would go after the home owner they are responsible for the upkeep of the sidewalk. You can go for any costs that your father may acquire do to the injury.

This is NYC, so the city may have liability. It is also possible your dad was just a clod and fell and no one is responsible but him.

Your dad was severely injured due to a fall caused by uneven footing.

This occurred in a city of lawyers and he should avail himself to a lawyer to determine accurately which of these parties (owner, city, or dad) is wholly or partially legally liable.

This is a personal injury case of ordinary slip and fall, and of course dad should pay nothing for an initial consult and any subsequent fee be contingent on recovery.

If the homeowner failed to maintain the sidewalk in safe condition, theoretically he could be liable for a fall
