Fell through manhole, need advice


What is the name of your state (only U.S. law)? Indiana


So last night I went to my friends place for a party he was throwing. I was walking behind his house and right by his back porch there was this manhole that was partly covered but the cover wasnt all the way on. I stepped on it on accident and my entire left leg went in before I could catch myself. I got a nce sized gash on my arm, my hip is bruised, and my back is killing me.

I wanted to know if, even though the manhole was in my friends backyard, is it still the city's responsibility for keeping it covered, and if so, is it realistic to pursue any type of legal action against the city?

It's on your friend's property, if anyone is liable it's your friend. Have you spoken to their homeowner's insurance yet?

No I haven't, I'm not even sure if they have that. Would it change anything if I told you they were renting the place from a landlord?

Then you need to find out the landlord's insurance as well as your friend's renter's insurance.

well if i were looking to take any kind of action do you think it would be against my friend or the landlord? I couldnt sue my friend, I wouldnt wanna do that to him. The landlord on the other hand I wouldnt have a problem pursuing since, according to my friend, is not too much of a nice guy.

well, if you were to sue, you should consider both. Neither may have any liability, both may have some liability or any combination of those two. If you do not sue within the alloted time, you lose all chances to sue.
Sue 'em all and let the judge release those he believes should not be there.

In most states, 2 years. Have you even seen a doctor? If you want to assert an injury you must receive treatment.

And if your friend has renters insurance, as all responsible and smart renters do, then a lawsuit won't personally affect him at all.

I haven't seen a doctor yet because I really can't afford it and don't have insurance. I am going to try and see one tomorrow if I can
