Fell at Wal-Mart


What is the name of your state? Texas
I fell at the local wal-mart in 2004 (September) I had gone up to check-out, I realized
I had forgotten something so I walked around my shopping cart and slipped on some water
that wasn't mopped up (they called it track-mopping) after they had run the floor cleaning
machine. I tried to break my fall but one arm slammed the cart, and the other hit the shelves that are filled with candy etc. They had me fill out a statement form. My back started hurting immediately, so did my wrist. They told me that someone from wal-mart would be calling me the next day to see how I was doing, they never did! I went to my doctor the next day, they took x-rays, and she gave me some pain medicine to take. I followed up with another visit. I had no insurance at the time, so going to the doctor wasn't an everyday occurance, especially since I got a letter from wal-mart stating that
they weren't responsible for anything.
I did contact a friend who is an attorney, for some advice. He said, for me to go get
help to try and make my back better, and when I have done as much of that as I can and I'm still not better, then to contact him again. Well I have been to a liscense Massage Therapist once a week and sometimes twice a week, since and things aren't any better
I'm just afraid I am going to have to eventually have surgery and then what will I do?
I also need to know if there is a statue of limitations on something like this? I do believe
wal-mart is responsible, I know that night after I fell, one of the girls that works there
told me that they had been having a lot of trouble with the floor cleaners, and she had just told them (or got on to them) for not track-mopping, which meant someone runs the big floor cleaner, and someone else track mops, mops up any water left behind after the machine. She said they hadn't been doing that, and they were supposely in trouble for that!
What should I do? Any advice would be greatly appreciated!

You left out two important things:

1. What is the nature of your permanent and serious injury (if any)? [If you don't have this, then you have no case.]

and

B. What is the dollar amount of direct and actual damages your permanent and serious injury caused you?
