Question

Former Employers


What is the name of your state? Delaware

I was recently hired as a consultant for a company. One co-worker (in a different department) is a consultant for a company I used to work for. He recently told an assistant manager of mine (the assistant manager told me) that my former employer (hiring manager to be exact) had said bad things about me. I have never dealt with this guy at work other than in passing, when we met, and mentioned that I used to work for the same company. He is in no way my supervisor or manager. I was very upset that a former employer would speak to someone (him) that has no business hearing anything about my past. Also, the bad comments have nothing to do with performance, they have to do with the fact that I turned them down for a job and went with another company and they felt slighted. I fear now that my new boss will get word of this and judge me based on this person's comments. Can I take legal action?

No, you can't.

For one thing, you have suffered no damages - you can't sue for something that might happen.

For another, we have a concept called Free Speech in this country - it means that he is entitled to state his opinion whether you agree with it or not.
