Friend fell through my glass table


California. A couple months back I had a couple friends come over for some BBQ and Drinks. We were having a good time and then all of a sudden one of my friends (I will call him Dan) snaps. His girlfriend was just speaking with another one of my buddies when Dan ran up and threw him against the wall. The next thing I heard was my $1500 Glass table broke into pieces. My friend Dan had a severe gash to his bicep that could have killed him had I not taken him to the hospital right away.

I am trying to have him pay for part of the damages ($1500 out of the total $3200). His girlfriend is threatening me that I will get in trouble because it was my house and he was under legal drinking age.

Question: Will I be liable for his injuries? Can I get into trouble because he was drinking at my house underage even though I did not provide the alcohol? If I took him to court to have him pay for the damages, which was well over $1500, would I have a chance of winning the case?What is the name of your state (only U.S. law)?What is the name of your state (only U.S. law)?What is the name of your state (only U.S. law)?

your friend was an invited guest. Chances are that you WOULD be found responsible. Courts tend to administer a greater measure of responsibility to the homeowner if the person is an invited guest, versus, say some one who cut through your yard.

As for the drinking, you allowed an underage person to consume alcohol on your property in your presence. What part of that responsibility are you questioning? I take it you are of legal age?

As for the damages, you could certainly sue in small claims. Whether or not you would win is a guessing game at best
