Guest injured while playing video game


What is the name of your state? California

I recently bought a Nintendo Wii, which is an interactive video game system where it uses motion sensors so that you act out the movements that you want to portray on the TV screen. I have a work buddy who was thinking about buying one and he asked if he could come over and try it out at my house. He is 27 years old, diabetic and obese and he thought it might be a good way to exercise. We played for about 30 minutes and during a virtual baseball game, he pitched the ball, lost his balanced and fell and claimed to have injured his knee. After putting ice on it there was no swelling and he claimed to NOT be in pain. He stayed at my house and watched TV for about 2 hours with ice on his knee and had some food food. Once he got up and put pressure on it he said it hurt. I wrapped his knee in an Ace bandage and gave him some of my old crutches. I then drove him home and had a friend follow me so I could drop his car off at his house.

The thing that worries me is that the whole fall seemed very fake and he seemed to be VERY over dramatic about everything and he did crack some jokes about "my lawyers will be in touch". Is he able to sue me at all for the injury?

By the way, the video game does show about 5 warning screens upon start-up saying stuff like "please consult physician before playing" and "may result in injury" and some other legal stuff.

there is nothing in your description of the accident that makes you negligent.

Did he mention if he was going to see a doctor?
