Gust of wind took canopy & hit someone in the face


What is the name of your state? Minnesota

I had a garage sale with three other friends at my house on May 3, 2008 & it was VERY windy out that day. We set-up a canopy to stand under to keep warm. A large gust of wind came in & blew the canopy across my driveway & hit one person in the face & another in the back. We did have two of the legs staked in the ground & the other two on the driveway. We never posted our garage sale in the paper or never had a sign in the yard.

What I am wondering - what would I be liable for & could I be sued, since we never advertised or had a sign in the yard - wouldn't they had entered at their own risk???

You might be found liable, but, since you staked down 2 sides, that could absolve you of responsibility.

However, no, they didn't enter at their own risk.

Unless the directions say stake down all four corners.

OP - Were the injuries severe? Did you get the names of the individuals injured? Have you let your insurance company know of the potential for claims?

Absolutely. OP knew it was windy, but did a half-a&&ed job of keeping it tied down.
