My girlfriend and her son were visiting me for my lunch break at work on 10/27/09. We went to the gas station so she could put gas in her vehicle. When I went out of the car I went to walk and suddenly felt myself drop and a strong pain in my right ankle. It was also raining and slippery. I noticed on the ground that there was a drain, almost like a ditch,on the ground for the water, leaves, dirt, etc to go into when it rains.( That is the best I can descibe it) The drain streched from one end of the pumps to the other. The section that I was walking on, witch previously I did not notice, did not have a grate over the drain, while the rest of the drain did. the section without a grate streched about 2-3 weet long, and when i fell in it, it must have been about 6-10 Inches at least. I felt my ankle pop as soon as I fell in it, and a strong pain shot up my leg. Not being able to walk, my girlfriend went into the gas station to ask for help. I could feel something was wrong with my ankle, so I kind of stepped like the opposite was it was hurting and i felt it pop back into place. This, also, was very painful, and was still barely able to put pressur eon my right foot. My girlfriend wanted me to go to the hospital but I had to return to work. The workers of the gas station looked like they didn't know what to do, but aknowledged that they had known there was no grate over the drain. I had asked to fill out an accident report, but there response was that "they did not have those there." So I had taken two pictures of the area I had fallen in, and the ditch without a grate on it. I dont know if I should go to the doctors because after applying ice, it does not hurt as bad. I would like to file a lawsuit, but I do not know where to start or what to do. Can you please give me some advice, tips, etc, to put me in the right direction, or even to tell me if it would be a waste of my time or not. Anything that would help would be appreciated. Can you do that?
