Hit dog with my car


What is the name of your state? OK


My fiancee was driving my car in our neighborhood at approx 25-30 mph when this small black and white dog ran right out in front of us. He didn't have time to stop and unfortunately the dog was hit. We stopped immediately and could hear the dog yelping......a young girl standing in the yard motioned for us to back up so we did because we thought the car was resting on the dog. The owner and her adult daughter were in the front yard when all this happened. We immediately stopped and got out......by this time the dog had moved over to the curb and we could see that it's right, back leg was badly injured. The owner was obviously very upset as was her daughter. My fiancee and I both felt badly and tried to console them both. The owner bent down and attempted to pick the dog up and was bitten on her hand......she then went into her house to wash her wound. While she was doing this a neighbor lady from accross the street came over and gave the daughter some towels and told her she would call her vet and see if they could take the dog there since the owner didn't have a vet herself. As she left to do this the daughter placed a towel on top of the dog and proceeded to gently pet the dogs head which the dog allowed. After a few minutes of doing this the daughter proceeded to try and pick the dog up to place it in her car**************.as she tried this the dog yelped and bit her on the chin causing a bad gash at which time she dropped the dog. She immediately started to walk to her house, as her mother was coming back out of the house she saw the blood. The daughter began to get unsteady on her feet as if she were going to pass out. I assisted the mother in getting her daughter into the house to clean her wound. After the wound was cleaned she appeared to be more steady**************the mother was telling her that she would probably need stitches and that both of them would need tetanis shots**************my fiancee and I both apologized over and over for the dog being hit and that we felt badly**************the daughter stated to her mother that she would take her kids and drive herself to the emergency room to see about her chin and advised the mother to try and take the dog to the vet**************at this time the neighbor from across the street came back and told them that her vet said she could take the dog there but to use a blanket to completely cover the dogs entire body and carry it like a sack to prevent being bitten. At this time my fiancee asked the mother for a pen and paper and he would write down his name and number so she could call us and let us know about the dogs condition**************as she was searching for a pen and paper we apologized once again at which time she stated that she understood and that the dog was just really excited to see her grandkids and that they were all about to leave together and take the dog with them when she ran out into the street**************.she stated that she realized it was an accident**************I know this is long but I wanted to get all the details down. Today my fiancee gets a call from the mother and she told him she had to have the dog euthinized due to it's injuries and she wants us to pay the fee of $85 to the vet**************she also stated that her daughter had to be taken to the ER by ambulance and have 17 stitches to her chin......which I don't see how this was possible when the daughter was already in her car about to leave when my fiancee and I left**************when my fiancee told her that he didn't believe it to be his fault that the dog was hit because it should have been contained either by a leash or someone should have taken it to the car, she said she believed that he was speeding (which he wasn't) and that not only did he hit it once but he backed up and hit it again**************my fiancee told her he backed up because he feared the car was resting on the dog and that the young girl in the yard was motioning him to back up so he did**************.she then stated that she would pursue it further and hung up on him**************...OK.....my question is**************.could we be held liable for the dogs death and furthermore what are the chances that she might also try to hang us with the injuries that she and her daughter sustained?What is the name of your state?

From your post, I don't see how you would be liable. There are leash laws in almost every city. They did not have their dog properly contained. In fact, if there was any damage to your car from this incident, they would be responsible for the repair.

That's kinda what I was thinking also**************and I even told my fiancee that if she did attempt to sue that maybe I should see if there was any damage to my car because that would hold up more in court than what she has to go on**************..but I'm not a sue-happy kinda person so I'm not gonna go there**************...but thanks for your input.

If this actually happened, it should be published as what not to do when you hit an animal. Mom got bit, kid got bit, you may have backed over the dog after you hit it. You have got to be kidding.

but, just in case it really did happen.

the injuries to the humans, not your fault or liability.

injury to the dog; did you actually back over it? If not, no liability. If you did; get out the wallet for the expenses for the dog and a new dog.

What kind of ************** punctuation ************** is this? I don't know how anyone managed to read your post.

English seems to be your first language; other than************** and ... and the lack of paragraphs, you have a good grasp of it. You would serve yourself well by sticking with proper punctuation.

Just a thought.

the ************* thing is a result of typing more than (some number, I thought it was 3) . in a row. something with the forum converts them to *

the following were all typed as .

.
..
...
....
.....
......
**************
**************.
......


but I do agree, the use if ... ad infinitum presents a poor post.

Some white space really makes a huge difference in readability as well.
