Hit by a peice of roof from neighbors home


What is the name of your state? NY
My wife was hit by a peice of roof from my neighbors home. They were having a new roof put on and the roofer left a pile of debris and shingles on the roof.
As she was entering my home a peice of shingle or debris hit her in the face. She has a fractured nose, 2 corneal abrasions. She probably needs surgery on the nose and she feels like hell. My health insurance I know will not cover this so I am assuming I have to go after the homeowners insurance? Or is it the roofers insurance? Also if we sue for personal injury who do I sue? The roofers also damaged the side of my home. They offered to repair it but they were so negligent with the roof that I was afraid they would repair my house and hurt someone else. They were well aware I was hurt and that the house was damaged and they kept being careless. What should I do?

File a claim with your homeowner's insurance and let them sort it out.

why won't your wife's health insurance cover her injuries?

I think initally they will but I think like with no fault when they find out someone else is responsible they will deny it. She is also going to miss alot of time from work and we have a baby. I am trying to find out who we can sue any help?

Your health insurance may cover this and then go after the insurance of the roof contractor and leave you out of it. The first thing your wife needs to do is take care of her injuries. Figuring out who pays for it in the end comes later.

Start by contacting your neighbor's homeowner's insurance company to file a claim. If they pay it, great. If not, you'll have to sue the roofer for the damages to your home plus the medical bills. You should have your house fixed by someone that you trust to do the work, then sue the roofer for that amount.

That isn't how it works. have your wife go through her health plan. That's why you have it.
