| What difference would that make? The driver who left the scene, if he was later caught, was likely not caught in time for any tests to be accurate. And if the second driver was not found to be negligent by the officer (if all the negligence is being placed on the hit and run driver) then there would be no reason to arrest him. Have you spoken to the officer and asked him these questions? Does it affect your wrongful death claims in any way?
