Question

HIT & RUN involving fatality


In the State of Georgia, I heard that if there is a fatality involved accident that the Georgia State Patrol is supposed to be called in and that all involved in the accident are required to be given a toxicology test. My father, who was a pedestrian, was hit by one vehicle which left the scene and then struck by a second vehicle which caused his death. The county officer gave my dead father a toxicology test but neither of the other drivers.

What difference would that make? The driver who left the scene, if he was later caught, was likely not caught in time for any tests to be accurate. And if the second driver was not found to be negligent by the officer (if all the negligence is being placed on the hit and run driver) then there would be no reason to arrest him. Have you spoken to the officer and asked him these questions? Does it affect your wrongful death claims in any way?
