How does somebody shoot a guy 4 times (Once in the head) and just get 30 days???What is the name of your state (only U.S. law)? Wisconsin. Incident: Arkansas. A little over 13 years ago in the state of Arkansas in the city of Little Rock I was shot four times. I was shot as a part of a gang ritual. “Shoot a ***** in the head and get into the gang.” There were four or five people involved. I did NOTHING to deserve this. The person that shot me was charged with misdemeanor assault and got 30 days in jail. The others just ran and when they were tracked down they were questioned and released without any charges. The police told me at that time that Arkansas had no such thing as a charge called “Attempted Murder.” At that time I was in no position to argue. Well now, after a lot of reflection and being safe in the state of Wisconsin, I wish to make right this wrong. I am told that there is a statue of limitations for civil rights that is three years. I posted in the civil rights section and was told to forget about it and get on with my life. This fellow should have been charged with attempted murder. His gang buddies should have been punished too. I want justice. This has been eating at me for years, but having had to work 7 day weeks for 9 years just to survive has made it tough for me to pursue this matter. Is there anything that can be done that will bring these people to justice? I want to see these people in jail where they belong. I have lived with this for years and still have nightmares about it. I don’t know how that has affected me. One cannot clinically judge one self with much objectivity, but something tells me it has affected my life. Thank you for your time. |

| you mentioned a statute of limitations of 3 years. I'm not going to argue that but use it and compare it to the fact this took place 13 years ago. so you understand what a statute of limitations is? if so, why do you think there would be any action available to you 10 years after the SoL elapsed?

Because...That is the statue for a civil liberties violation. What I am seeking is something akin to wrongful prosecution. To my limited knowledge and or common sense attempted murder should have no such limitations? If someone gets millions for a hot cup of coffee... What I want is justice, not some sort of award. Mark |

| The person who shot you was already prosecuted for the crime and served a sentence. He can't be charged again for the same crime. You have no recourse. I would guess there was a plea bargain in place and that's why it was an assault charge instead of attempted murder.

| You need to get counseling--or more counseling--or find some other way to deal with this besides going after the guy that shot you. You're trying to get somebody convicted twice for the same crime, 13 years after it happened, 10 years after the SOL. That's just not going to happen, no matter how many times you ask. Don't be incredulous at the insufficiency of the charge. There are murderers walking the streets that didn't even get thirty days. Our justice system doesn't provide justice 100% of the time, and you're an unfortunate victim of that reality. |
