Hurt on a Miltary Base


What is the name of your state (only U.S. law)? California

I am seeking advice. On July 17th I was injured at a base pool on a military installation. One of the steps on the ladder to enter and exit the pool was broken. The slats were damaged. On exiting the pool, I noticed this and tried to avoid stepping on this step. However, my right foot went right through the cracks an broke the other slats. As I pulled the foot out I noticed it was bleeding and a gash on the back of the heel.

I alerted the leftguard, and he came over and saw it was bleeding. The other two remaining lifeguards came and assisted me. One cleaned the, wound with alcohol, an provided a large bandage. Blood was everywhere. They then wash the area where I had been standing with bleach and a hose.

I asked for an incident report. One of the lifeguards claimed they did not have those, they only have disciplinary reports. I told him well I need an incident report filed.
He went and got his supervisor, who said, "yeah we have incident reports." What he brought back was the same disciplinary report with the word "disciplinary crossed out" and incident inserted.

I told them I am diabetic was cut by metal. I was very concerned. He took my statement of events. I asked him for a copy. He stated they don't give out the copies that way. He would put it in an official form an email me a copy. (So, I provided my email address).

I went to the doctor and because of my history of diabetes was given immediate appointment. I was able to take a picture of my wound (prior to the doctor irrigating it).

My question is this. Today is July 22. I have not heard from anyone from the base facilities (pool manager) regarding my incident. I also forgot to state as I was waiting for the lifeguards to attend to my injury, the other lifeguard IMMEDIATELY fixed the slats.

My foot is now worse. I have another appointment tomorrow. I am extremely worried.

Do I have a case? or because I have not gotten a copy of the incident report or pictures of that broken slat have no case.

Thank you for anyone reading who might be able to assist me. There is a strong possibility I might lose my foot. Hopefully not.

I assume you are a civilian. What were you doing at the base?

Either way, it is very unlikely that you will get any money out of it, even for medical bills. Absent gross negligence, they have governmental immunity.

I am not a civilian. I am a dependent of a military member. I have complete base priviliges. The base pool is public, it is not geared towards military members only. As long as you have a military person check you in any facility on base, anyone can gain access. I have gotten the pictures that show that it was indeed their negligence and currently I am seeking someone that is aware of "government" law. The base pool is run by a private sector, even though it is on a military installation.

If you are not enlisted in the military, then you are a civilian. That's what civilian means.
