Question

Husbands Fall


What is the name of your state? New York- Does anyone out there know what I should expect.Right after Thanksgiving we had 4 or 5 inches of snow.My husband and I went to funeral,and suprisingly they were putting deceased in ground,despite weather.We drove to cemetary for service.Road conditions in cemetary were horrible.They hadn't plowed or sanded.It was icy under snow and every body was walking slow and cautiously. Just so happens my husband had both feet go out from under him and he landed like a ton of bricks. After 6 hours in ER, found out he broke his pelvis. After a lot of pain and on crutches for 12 weeks,doctor says hes as healed as he will get,but expect arthiritis and probable need for hip replacement down the road.We have a lawyer checking into responsibility for insurance charges by cemetaries lack of taking care of walking areas,knowing there was people coming for funeral.Lawyer has sent all of doctors notes.What should we expect form ins.company? Any ideas ?

The insurance company will likely defend that cemetary did not have sufficient time to remedy the condition before the funeral and that your husband did not exercise due care under the circumstances. Good luck.
