Injured daughter by another boyWhat is the name of your state? Maine My 14 year old daughter was on a school sports field ( after school hours) when a boy about the same age, who had a stick thrown at him picked up a rock and threw it in retaliation at the other boy who threw the stick. It did not hit the other boy but my daughter who had to be rushed to emergency to see if the ankle was broken. Is the parents of the boy responsible for his actions even though it was not intentionally directed at my daughter but the boy who threw the stick. Could I sue them for medical deductible/copay resulting from this incident? My daughter had two other girls of the same age with her to colaberate the story. I have contacted the parents of the boy who threw the rock and informed them of the incident. They refuse liability. What is the name of your state? |

| The other parents are idiots. If there were witnesses, and the story you told is fact, then YES, you can go after them for your co-pay and deductable.

In fact, you are so astonishingly correct in this matter, it will not surprise us one bit if you are offered a generous settlement, because, by golly, that’s just how it should be.
