Question

Injured in fall, soap on floor, dimly lit restroom


Massachusetts

My husband went to use the restroom in a Chinese Buffet Restaurant, and the restroom was poorly lit. He didn't notice that the soap dispenser was not on the wall, and all the liquid soap was on the floor in front of the stall, and he slid in it. He twisted his knee and back, slammed his knee into the urinal and at the same time, reached for the wall to grab himself, hitting his shoulder.

He did contact a lawyer and started going to physical therapy for his injuries, but about halfway through the therapy sessions, he got a phone call from his attorney telling him to stop the therapy, the restaurant wanted to settle. (despite the fact that his knee still had problems)

He did as his lawyer instructed and waited. Each week he would call his atty. and ask for a return call, but didn't get one. Finally after several weeks we were told that the atty for the restaurant had retired and someone new was taking over.

Today they have made an offer of $4,000. All atty fee's and a $2,000 medical bill is to be deducted from this, so he refused and said, if they pay all medical, then give me that offer, I will take it.

His atty said he needed to reconsider the offer and if he didn't take it, the atty will not file a suite.

This just doesn't seem fair to me, as he is still hurting and now feel's he's being forced to take a lower amount because of my/his attty's personal reasons of whatever, and I have no clue what to do. Massachusetts

Sounds like a good offer to me; the restaurant wants to settle a nuisance suit.

(You didn't mention any permanent and serious physical injuries.)

Enjoyed the switch in perspective. Everything was about "your husband" until the last paragraph when it switched to "I" and "me".

NEVER TAKE MEDICAL ADVICE FROM A LAWYER. If he still needs treatment for the injury, then he should continue treating! His lawyer is an even bigger idiot then he is.

I wonder what the likelihood of collecting from a Chinese store owner is?


(That sounded a bit racist even to me but it was not aimed at the entire race of people just shop owners)
