| | | | Injury at a Casino In Vegas I am trying to help out my friend's mom, who was injured at Circus Circus in Las Vegas, Nevada. The incident happened a while ago, and the statute of limitations will run out in January. She had found a lawyer in her state (NY) who tried to bring the case to court, but for whatever reason it took them a year and a half to notify her that it was out of their jurisdiction. She has been trying to find a lawyer in Nevada who would take her case(she has spoken with almost 20), however, it is proving to be very difficult because no one wants to go up against a casino. Her injury occured while she was at a slot machine, she turned around to walk away from the machine, when someone had left a stool in the aisle. As she turned away from the slot, she bumped into the stool, which caused her to lose her balance. She then fell on the stool (which was wrought iron and had no protecters on the legs) and it penetrated into her groin area, to the depth of about 3 inches. She was told by Circus Circus that they would not help with her medical bills (she was in the hospital for part of her stay in Vegas) and they didn't refund her money for the nights of the hotel even. She required several surgeries at a high medical expense. She would like to be able to sue them for at least the cost of the surgeries. She has photo documentation of the injuries, and the Casino has video tape that they are not willing to release.
Does anyone have any advice as to how she should go about finding a lawyer who is willing to take her case???? |

My response:
This has NOTHING to do with whether an attorney will "go up against a casino." It's done all the time.
The problem is that, and from your description of the incident, there's simply no liability on the part of the Casino. All because someone injures themselves, doesn't mean there's liability. Simply, she failed to look where she was going.

| | | | Even though the stool shouldn't have been there, and the iron was exposed? All I know is what the attorneys have told her, which is that it would be too difficult to go up against a casino......
