Insurance Claim

What is the name of your state? MO I was rearended on July 5, 2005. My neck continues to have soreness and stiffness. The person in fault's insurance company wants to settle the claim. What are suggestions? Should I settle the claim? How long do I have to settle? The accident happened in Illinois, the driver who hit me lives in Wisconsin and I live in Missouri. What would be a fair settlement? My truck which was totaled in the crash has been replaced and my doctors bills have exceeded $500.00. Should I ask for pain and suffering?

Ins claim

How much are they offering? What are you looking for? Do you have a Lawyer? I don’t think you need one in this case if the injuries are not too serious. Did you miss any work? If you truly suffered pain, yes I would go for some pain and suffering. Depending what State you are from you have 2-3 yrs to file a lawsuit so make sure you find that out soon as possible. So you have 2-3 years to settle your claim before you would have to file a law suit if the insurance co. doesn't payout. I know the state we live in we have 3yrs to file a lawsuit and we need 2,000 in Medical expense to even file a lawsuit. What are you looking for? Doesn’t sound to me that this would be huge bucks, but if you come up with a reasonable amt that you think is fair and work with the insurance co. and I am sure you both can settle this fairly.

I have been told the settlement is usually 3-5 times that of your medical bills...which includes pain and suffering.
