Kid hurt at my house


What is the name of your state?NY
a friend brought her kids over to play today 5 years old. SHe had her neighbor with her too. He is also 5 so are my kids. I have never met the neighbor kid or his parents and of course he got hurt. The boys were digging for worms and the kid was hit in the mouth with the shovel. He cut his lip and gums above his front teeth. We brought him home and I apologized (and met) his mother. She said no problem acciedents happen, yadda, yadda, yadda. SO I called my friend to get the phone number to check on the kid and she said she did not have it but she had just checked on him and he was laying on the couch and his mom said he was fine. Now I am scared to death that they are going to sue me. I am planning on going by tomorrow morning to check on the boy since I don't have their number. Is there anything else I can do? Should I call my Homeowners Ins? Please advice would be great, I am worried sick.

First off, calm down and breathe.

Secondly, you don't need to get you homeowner's involved yet. Since it sounds like the mother is understanding it was an accident and by your post it doesn't sound as if she needed to rush him to the ER or anything.

So sit tight and check on the kid tomorrow.

You might want to read the "notice" clause of your homeowners' policy to check the requirements. Failure to provide prompt notice could result in a (legitimate) denial of a future claim.

I agree tototally and should have stated that.

My2sons should look at her policy and read what is required (even if the other parent doesn't want to file a claim now, it is still a possibility).

Hopefully the boy is doing better today and it won't be an issue.

I went to see him today and he was as happy as ever and he told me he was fine and switched the suject to something else. Keep in mind I don't know this child or his mother. Then his mom came out wit tylenol and gave it to him. She said he seems fine and they have an appt Tuesday for an xray of the tooth that the cut is above. He is 5 and it is a baby tooth, so I am grateful for that. The mom was fine and she really acted like there wasn't a problem. I hope it continues. His lip is healing, no swelling and a very small cut as well as his gum area right above his tooth is cut, again very small. I have to go to my insurance office tomorrow to drop something off, so I will let them know at that time. Should I have offered to pay for the dentist visit? I just thought about that. Maybe I should? Or should I just try to back off and let them do their thing? I am trying to put myself in the *mom's* place and if it were me I wouldn't think twice about the injury and just write it off to *it's not the first time and it won't be the last*. But, not all people are like me. I guess that is why I am here. Thanks for listening.

ETA...I just called my HOI agent and he said there is nothing to worry about at all. That I was not negligent and not to stress over a problem which is not mine (yet). He added that if for some reason they did come after me for something that I would be covered and they would stand behind me and provide me with an attorney, but he reiterated that I should not be concerned bc that is why I have HOI. Also, I asked him if I needed to offer to pay the dental visit payment and he said no. So, I am satisfied for now. I am cautiously optimistic and hope it will all just go away and I am just being a worry wort. Thanks for your advice to check on my policy

Yes, not everyone is sue happy. My son broke his arm at a neighbor's house (swinging on clothes line pole), because another kid was pushing him trying to get him to do a 360 around the pole. He made it about 85 degrees up and couldn't hang on and fell. Needed a specialist and surgery.... Lucky he didn't break his neck.

I know the neighbor's were afraid that we were going to sue, but we were insured and $hit happens.

Good luck in your situation and don't worry, because that is what you pay insurance for.
