... As I was looking into the display case, a large, at least 220lb "employee"decided to knock me out of her way as she walked through the line ...

... they say they're sorry, open a case, next day case specialist calls, email's me, I return the email with the pictures of my now red and black bruised arm ... I informed the specialist that my arm still hurts, a lot and I'm going to the hospital to have it checked for a tear.

I get there, doctor checks it, diagnosed with a contusion, x-rayed for joint damage, released with a Motrin script, arm wrap and will be billed. I'm giving Starbucks until Monday as they've requested. I've never sued before, but I will this time. No way I'm going to let someone just hurt me like that. I've been a Starbucks customer for a dozen years and I'm pissed off!

My question is, can I press charges? For assault or something of that level?

I would wait to hear back from Starbucks on Monday. In the meantime, I suggest you use drive-thrus so there is no risk of anyone else bumping into you. All you have to worry about then is spilling hot coffee on yourself.

Starbucks has all of this on video, and will be getting back to me on Monday. This was no accident, it was as intentional as possible. I've lived in Philadelphia most of my life, visited NYC *a bunch of times, and now live in L.A. for the last couple of years. I've been accidentally bumped into numerous times, I can tell the difference.

What you "know" will be meaningless in a court of law. While Starbucks might feel their way clear to give you a brief apology and a free drink card, there virtually no way that you will see any criminal or civil action as a result of this unless this employee confesses to battering you on purpose.

I have a Starbucks account, and when something happens, such as a bad drink etc, it's better to call in so it gets documented and funds replaced. I call in immediately, they say they're sorry, open a case, next day case specialist calls, email's me, I return the email with the pictures of my now red and black bruised arm.

This woman would have had to bulldoze you like a linebacker for that to happen! If that is so, then maybe you have a case ... I just find it very unlikely. Note that a doctor cannot say how or when your injury happened, only that it did happen and maybe what sort of impact it might be consistent with.

Criminal battery requires intent. Unless eh confesses to doing this on purpose or the video clearly shows she lowered her head and charged you, that ain't gonna happen. You can try to report it to the police, but don't expect anything to come of it.

You are certainly free to consult some attorneys and see if they do a happy dance and offer to take your case on contingency. If they want $20,000 or more for a retainer, you have no case.

I find it very difficult to believe this employee bumped you so hard you were bruised. are you especially susceptible to bruising? Now, if you had tried to elbow her then I can see how you might have injured yourself but otherwise; not unless you have medical issues that cause you to bruise especially easy.

If you want anything to happen yes, you have to do something. The fact you did not report it to the police shows you did not believe any crime took place and unless you sue and win nobody has to give you anything
