legal responsibility for a fall and injury of a parent


What is the name of your state? Florida
I am residing in New York City but my 97 y old father who is mentally competent but frail
and frequently falls when unsupervised, even if he uses a walker. lives in Florida.
My father has a live in aide who stays with him 24h a day.Understandably, the aide needs 6-7 hours of sleep.If my father gets out of bed while she is sleeping and sustains a fracture
could the aide and /or I be considered negligent.(eg could the authorities postulate that I should have known that such a scenario is possible and I should have seen to it that he has a second aide while the first one sleeps.It should be mentioned that even though I am his only close relative and I have his power of attorney to take care of his affairs, I was never appointed as his guardian.I might add that because of the limited financial resources hiring a second aide would not be possible.

Did this situation actually happen, or is this a what if question?

The authorities aren't going to find you liable for something like this.

This was in fact " what if" question I neglected to mention that I am the owner of the condo in which my father is residing.Does it make a difference?

You bet it does. If you have homeowner's insurance, they may cover any it, otherwise, you can be held liable as the owner.
