Liability


What is the name of your state? Oregon
Hello, my son has built a dirtbike track at a house he is renting from me. I authorized him to do this because he does race dirtbikes. My question is???? His friends would like to also ride and I am afraid of a liable suit if someone gets hurt. I know when he goes to race at a local track they have you to sign a liability waiver before they let you in the gate even if you are just a spectator. If I were to have each of the guys to sign a waiver similar to the one they use at the track would I be protected from being sued if one should get hurt? If so where would I get such a form? Your help is deeply appreciated.

Having them sign a waiver will not prevent them from suing you for negligence on your part and winning. It also won't prevent them from suing you for their own stupitidy, but it makes it marginally more likely that you will prevail in a lawsuit.

I doubt that your homeowners insurance company would be too happy if they found out about this.

Not strong enough of a word. They will cancel the policy, and OP will have an extremely difficult life trying to find another one. However, there is a new home insurance product coming out that will be less expensive than force-placed insurance. However, it will probably be 5x the cost of her current policy.

Quite right, I sometimes speak in hints instead of being more blunt. But its hard to convey the proper tone (follow this hint or die) when speaking in a message board.
