Middle School Student breaks my son's nose in school.


What is the name of your state (only U.S. law)? Michigan
During lunchtime, in the school gym, child 'A' took a hat from child 'B' and threw the hat to my son. Child 'B' went up to my son, said nothing, and punched my son in the face, breaking his nose. We ended up at an ear, nose, and throat doctor who reset my son's nose. My son had to be sedated for this. This has been a tramatic experience for both me and my son.
I have lost time from work, my son has missed school and there are medical expenses. I am not sure what to do at this point. I would like to recover my expenses, but who is the responsible party? The school or the parents?What is the name of your state (only U.S. law)?

This is not a duplicate.

It sounds to me like your son was an active participant in the roughhousing and was trying to downplay his role when he told you about what happened. I think that all 3 of them are equally to blame and your son was just the unlucky guy who picked on the wrong kid and got hurt. You have no grounds to recover anything from anyone, and I hope your son learns a lesson about this kind of shenanigans.
